Contested Probate

Dealing with the loss of a loved one is difficult enough without the added stress of a dispute over their estate. If something doesn’t feel right, whether it’s the contents of a Will, the way an estate is being handled, or concerns about those involved, it’s important to understand your options.

We can help you make sense of what can feel like a complex and emotional situation. We’ll explain things clearly, guide you through your next steps, and work with you to find a practical way forward.

What is contested probate?

Contested probate (sometimes called contentious probate) covers disputes about a person’s estate after they’ve passed away. This could involve concerns about whether a Will is valid, how it’s been interpreted, or how the estate is being managed.

These situations often arise where:

  • a Will has changed unexpectedly
  • someone feels they’ve been unfairly left out
  • there are concerns about pressure or influence on the person who made the Will
  • executors aren’t acting properly or communication has broken down

How we can help

We support individuals, families, executors and beneficiaries with a wide range of probate disputes. Our approach is always practical and proportionate – resolving matters where possible, but acting firmly when needed.

We can advise on:

Challenging a Will – including concerns about capacity, undue influence, or fraud
Claims for financial provision – where reasonable provision hasn’t been made
Executor disputes – including delays, lack of transparency, or misconduct
Removing or replacing executors
Disputes between beneficiaries
Issues with the administration of an estate
Interpreting or correcting a Will - where something isn’t clear or has gone wrong

Challenging a Will

There are situations where a Will may not reflect someone’s true wishes. For example, if they were unwell, under pressure, or didn’t fully understand what they were signing.

These cases can be complex, and the legal threshold is high – but we’ll give you an honest view on whether you have grounds to challenge and what’s involved before you take any steps.

Claims for financial provision

Even if a Will is valid, it may not make reasonable provision for certain people. Spouses, children, cohabiting partners, and dependants may be able to bring a claim under the law.

We’ll help you understand whether you’re eligible, what you might be entitled to, and the time limits involved.

Resolving disputes

Not every dispute needs to end up in court. In fact, many can be resolved more quickly and cost-effectively through discussion or mediation.

Our approach is to:

  • assess your position clearly from the outset
  • gather the right information and evidence
  • resolve matters constructively where possible
  • take formal legal action where necessary to protect your interests

Throughout, we’ll keep things straightforward and transparent – including costs – so you feel in control.
