What is a Settlement Agreement?
A Settlement Agreement is a legally binding agreement in which an employee waives the right to bring any claims against their employer. In return, they are paid a sum of money and usually agree as well to keep the agreement, and the circumstances that led to it, confidential. Wording for a reference will also often be agreed.
Settlement Agreements will usually terminate the employment relationship but that does not necessarily have to be the case. As an example, a Settlement Agreement could resolve a complaint of discrimination brought by an employee but leave the employment relationship alive.
It is a legal requirement that employees take independent legal advice before signing a settlement agreement.
