Traditionally an application for Probate has been a paper-based process. The Probate Registry has now started a process of modernisation along with the rest of the court service and the majority of applications must now be made online.
While this may suit some people not everyone is, or indeed wants to be, tech savvy.
At Vine Law we appreciate that where people previously might have been happy to deal with a paper-based application for Probate on their own they might now want assistance with making the application online.
If you have gathered all of the information about the assets and liabilities of the estate, we can make the online application on your behalf.
We will ask you to provide us with the original Will and any codicils to it, evidence of asset values and the outstanding debts together with evidence of your identity before making any application.
Accelerated Probate Application Service
Where the estate fits the following criteria:
- The asset and liability values have been established
- The Asset value is below £325,000 (or £650,000 where the deceased was widowed)
- The deceased did not own any foreign property valued at over £100,000
- They were not in receipt of any benefits from a trust valued at over £150,000
- They had not changed or disposed of their pension in the two years before death
- They had not made gifts of over £150,000 in the seven years before their death
We may be able to deal with the estate under our Accelerated Probate Application Service.
Under the scheme we will ensure that the application is completed and submitted to the Probate Registry within 7 days of our first meeting with you if you are able to supply all the required information at that meeting.
Whilst we will deal with your application as quickly as possible, we are not able to guarantee when the Grant of Probate will be issued. The Probate Registry currently has a large backlog of applications and timescales indicate that it may be 3 to 4 months before the Grant is issued.
