Lasting Powers of Attorney – More important than ever
Lasting Powers of Attorney – More important than ever

We know we have told you before how important Lasting Powers of Attorney are, but we won’t apologise for repeating ourselves.  Putting Lasting Powers of Attorney in place is the only way to ensure that you can appoint the people that you trust to look after you and your finances, if you aren’t able to make decisions for yourself.

We understand that the cost of putting LPAs in place may be a barrier to setting them up at the moment so we’ve reviewed our charges to try to help.

There are two types of Lasting Power of Attorney: one covering Health and Welfare decisions and the other Property and Financial Affairs.

Health and Welfare

If you have definite views about the type of medical treatment, or care that you would want to receive, then a Lasting Power of Attorney is the only way to ensure that you can have your say even if you lose capacity.

Without an LPA for Health and Welfare it would be for the medical staff to decide what treatment was appropriate for you.  This might mean that you would receive treatment that you would not have given consent for if you were able to make those decisions yourself.

Property and Financial Affairs

Even as a married couple if you lose the ability to manage your own affairs, your spouse will not be able to access money held in a sole account in your name, however vital those funds might be to continue running your home or to providing care for you.

With the increasing costs of living, you might find that you are having to access savings to cover the basic living costs.  If you couldn’t access those savings, would it cause you difficulties?

Professional Advice

Using a professional to draft your Lasting Powers of Attorney means that you are able to build in safeguards and to give guidance and instructions to your chosen Attorneys that will be approved by the Office of the Public Guardian, the body responsible for registering the documents.

Our charges

At Vine Law, we absolutely recognise that rising living costs are having an impact on the choices that people are making on a day-to-day basis.  We feel that it is important for everyone to have access to professional advice and assistance when putting Lasting Powers of Attorney in place. After reviewing our charges we are offering the following options.

Our standard fees for drawing up Lasting Powers of Attorney are:

£550 plus VAT (£660) for both LPAs for an individual

 or

£950 plus VAT (£1140) for both LPAs for a couple (4 x LPAs).

If you instruct us to draw up LPAs and are able to pay in full at the time you instruct us, we are currently offering a cost-of-living discount of 20% reducing the cost to either £528 or £912 (inclusive of VAT).

If you aren’t able to pay in full at the time you instruct us, then we are offering you the ability to split your payments in to three equal instalments.  You would make the first payment at the time you instruct us, a second payment one month later and the third payment when the LPAs have been registered, usually around 4 months later.  We are not able to apply the cost of living discount to this offer.

The only other costs payable are the Office of the Public Guardian Registration fees and we will work with you to see whether you are able to obtain a reduction or full discount on those fees at the time of making your application.
